Through the SALES MANAGEMENT service, we will publish your adverts, promote your items and manage your sales through our own Merkopolis Shops or, alternatively, create a shop in your name so that you can manage it yourself. If you are willing to publish your own adverts, there is no need to contract this service. You can just hire a shop directly from the SERVICES section with an unlimited number of adverts per year.

(*) If you chose the option MERKOPOLIS SHOP, it is you who has to determine the offer you deem appropriate for our consideration, the type of product and the Retail Price being the two elements that we take into account when studying your proposal. Obviously, the higher the price of the item, the lower the commission percentage we expect to receive to offset our management costs. The sale of a house for � 250,000 cannot be treated the same way as the sale of an article of clothing for 25 �, to give just two examples. The agreed percentage will apply to all items, but depending on the price of each item, it can be increased or reduced individually afterwards if agreed by both parties. If you just want to create a shop in your name (OWN SHOP), you will not pay any commission. You will simply pay the amount for the publication of advertisements and annual hire of the shop at the advertised price in the Services section, a procedure that we can also carry out on your behalf in order to facilitate the process. In both cases you will receive an email with the invoice to be paid so that we can proceed with the publication of your adverts.

Acceptance of the conditions

The following conditions relate specifically to the SALES MANAGEMENT SYSTEM and are complementary to any other condition of Merkopolis that has already been accepted by the Contracting user ('User').

1. MERKOPOLIS UNDERTAKES:

1.A. Merkopolis will publish the number of adverts contracted by the User at the price agreed on this application.  Publication will begin within 14 days from the date of delivery by the User of all materials required by Merkopolis for this purpose (basically images and text), ending when the goods to which the adverts refer to have been sold. If the goods have not been sold, the corresponding advertisements will continue to be published (every 10 or 30 days) for a period not inferior to 365 days (Merkopolis could choose to continue announcing all or some of the adverts when this time has expired).

1.B. Merkopolis agrees to modify the price, images and texts of the Advertisement at the request of the User and at no additional cost, provided that such modifications are considered reasonable and appropriate by Merkopolis according to their own discretion. In the event that the User requests the removal of some of the adverts, the adverts removed will be counted as a published advertisements.

1.C. Merkopolis undertakes to manage sales inquiries and merchandise relating to the goods of the User, including advance payment of the amounts by the buyer and the dispatch of goods to the buyer (in the event that the goods have been sent to Merkopolis for prior inspection) and, in cases of return of goods, from Merkopolis to the User. In both cases, Merkopolis agrees to inspect the goods and document the inspection before sending them to the buyer or, in the event of return of goods, to the User.

1.D. Merkopolis agrees to pay to the User the agreed amount in each case. This amount payable will be equivalent to the sale price announced (excluding delivery costs and tax), plus those delivery costs incurred by the User, less the corresponding commission for each advert. This amount will be paid to the User once confirmation of satisfaction has been received by the buyer and once the corresponding invoice, issued automatically by Merkopolis on behalf of the User, has been generated.

1.E. Merkopolis agrees to fully return to the buyer the amount paid by him/her in the event that the buyer is not satisfied with the purchase, provided that the return takes place after the goods in question previously delivered to the buyer have been returned to Merkopolis. In the event that the goods have been lost or damaged in transit by a company contracted by Merkopolis, Merkopolis will carry out the corresponding claims and will pay the User the amount due, but not before receiving it from the company responsible for the delivery and/or the corresponding insurance company.

2. THE USER UNDERTAKES:

2.A. The User agrees to respond to email inquiries by Merkopolis regarding his/her advertised goods within a period of time not exceeding 24 hours, except when the consultation has taken place during the weekend or a holiday, in which case the period will be increased to 72 hours.

2.B. The User agrees to send the goods sold by Merkopolis in his/her name to the address indicated by Merkopolis within a period of time not exceeding 24 hours from the time and date of the delivery request made by Merkopolis, except when such request is made at a weekend or holiday, in which case the period will be increased to a maximum of 72 hours. Date and time is understood as the actual date and time of dispatch from the place of origin and not the date and time of arrival at destination.

2.C. The User agrees to employ a delivery method that certifies, by means of the corresponding signature of the recipient, the arrival of the goods sent and which guarantees the appropriate financial compensation in the events of loss or physical damage to the goods.

2.D. The User agrees that Merkopolis reserves the right to refuse admission to the User as a customer or to refuse publication of advertisements concerning items deemed inappropriate by Merkopolis, provided that the corresponding amount paid by the User is fully refunded .

2.E. The User agrees to share with Merkopolis on a 50/50 basis the delivery costs (from the User to Merkopolis, from Merkopolis to the buyer, from the buyer to Merkopolis and from Merkopolis to the User) in the event that the buyer chooses to cancel the purchase and return the goods purchased. In the event that the goods are lost in transit or arrive damaged (to Merkopolis, to the buyer or to the User), the User will not make any claim against the buyer or against Merkopolis, but only against the companies used for dispatching the goods.

2.F. The User agrees that in the event that Merkopolis considers that the goods submitted by the User do not correspond to what it has been advertised, Merkopolis will cancel the sale and return to the buyer the full amount paid without proceeding with the delivery. In the event that the User is responsible for this situation, Merkopolis reserves the right to claim financial compensation to the User equal to the agreed commission (plus delivery costs and bank charges incurred by Merkopolis) prior to returning the goods.

If your articles are not considered suitable for our shops, we will return the amount paid or, alternatively, we will create a shop in your name so that it is you yourself who manages it, if you so wish. INFORMATION REGARDING THE SERVICE OF A MERKOPOLIS SHOP

It is not always possible to properly manage conventional and electronic commerce simultaneously. Whilst the basics are the same -excellent customer service, competitive prices, good presentation of products, prompt delivery, a refund policy- when selling on the Internet, we have to take into account other operational, advertising and logistic aspects which required a specialized infrastructure and personnel.

Merkopolis offers as a solution the possibility to manage all your sales through our own online shops so that you can focus exclusively on attending your offline trade. You just need to contract the service and email us the material we request (basically, photos and text). And if you have a website with all your items, we can import them directly into our system, speeding up the publication process. After posting your adverts, they will rotate to the top position every 10/30 days until we find a buyer.

The system is very simple. We will buy your item at a special price, previously agreed, once we found a buyer. Obviously, it has to be a competitive price below the price you have posted on platforms other than Merkopolis, because to that price we will add our commission, plus taxes and shipping costs involved. It is also possible that if we have not worked with you as a provider in the past, we request the submission of articles to Merkopolis for our previous inspection before sending them to the customer, a decision that we will take in each case and that would increase the delivery costs.

Once the sale is made, we ask you to enter the shipping costs so that we can communicate the final price to the buyer and, upon receipt of payment, we will ask you to make the shipment. Once the buyer is satisfied with the purchase (he/she will have a maximum of 14 days to return the item), we will pay the amount. If not satisfied, we will return the goods to you and will refund the amount paid to the buyer. You will find more detailed information on the Conditions of Contract.

The Sales Management service can be summarized in the following five tasks:

(*) In the event that you buy a voucher for more adverts than you now need, you can request the publication of the remaining adverts in the future, with no time limit. If you wish your advert to be published in additional languages, please request a quote for translation into the required languages.
